Can people with ADHD be entitled to benefits?

As long as you are a child diagnosed with ADHD and the condition is so severe and it is inviable to provide your subsistence.

If all these requirements are met, it will be possible to achieve the BPC/LOAS benefit.

But remember, the grant of the benefit depends on the evaluation carried out by the National Institute of Social Insurance (INSS) and/or the judicial system. It is necessary to present medical documents which attest to the condition of disability and proof of family income, as well as other documents.

What is BPC/LOAS?

The Continuing Benefit (BPC) of the Organic Law on Social Assistance (LOAS) guarantees the elderly and disabled persons financial assistance, worth a minimum wage, to have minimum survival conditions.

It is necessary to observe that some requirements need to be proven, including low family income. So it is not an exclusive benefit of those who have ADHD, the applicant must also prove low income.

Therefore, some common documents of being required are:

  • Up-to-date medical report with the ICD of disability + social barriers (difficulties) faced;
  • Document proving that the family is registered in the Single Registry;
  • Confirmation of RENDA, which must be equal to or less than 1/4 of the minimum wage;

They can also be added:

  • School statement to demonstrate the delay in learning and limitations in school awareness;
  • Professional statements: Psychologists, Phonoaudiologists, Neuropsicopedagogo.

What to do if my request was rejected?

If this occurs, then it will be necessary to hire a lawyer or public defender to enter with a lawsuit asking the INSS to recognize the ICD of this disorder.

Currently, ADHD is classified as hyperkinetic disorder, with ICD F90.

Once the benefit is requested with the INSS, it is necessary to wait for the grant to receive the grant.
